We take civil law marriage as the norm for marriage. The conditions which made this usage work do not exist for us in the United States. Contemporary conditions here support common law marriage as the norm for marriage.
Civil law marriage is designed for the setting in which potential spouses and their families mature in proximity, ideally for more than one generation, so that they are familiar with one another before they marry.
Common law marriage is designed for the setting in which potential spouses and their families do not mature in promixity and may not share sets of intellectual or social customs.
Our contemporary conditions in the United States require that our state and federal governments, including our military services, regard common law marriage as the norm of marriage.
Normalizing common law marriage would significantly lower stress on our citizens. Details are easily worked out and codified.
